A new Pennsylvania law mandates that thousands of vape retailers across the state purchase products exclusively from state-certified manufacturers, according to a statement April 9 from Attorney General Dave Sunday.

The law, known as Act 57 of 2025, requires every manufacturer of electronic cigarettes that contain nicotine and are sold or offered for retail sale in Pennsylvania to be certified by the attorney general’s office.

A public directory of approved manufacturers and products will be posted online by June 20, and will include brand names, product types and flavors that meet the law’s requirements.

“The law will ensure that only e-cigarettes that contain nicotine, have FDA approval or are pending review as preexisting products (on market by Aug. 8, 2016, and premarket tobacco product application submitted by Sept. 9, 2020), or meet specific requirements, are listed on the directory,” the attorney general’s office said in a statement.

There are currently approximately 11,090 other tobacco products (OTP), which include vape and e-cigarette licensees in Pennsylvania, the attorney general’s office said.

“We commend legislative leaders for taking action to protect children and other Pennsylvanians from consumption of unregulated products,” Sunday said. “The legislature has provided my office with a variety of tools, including significant penalties, the ability to seize unlisted products, and cost recovery from illegal actors, that will help us keep these products from being marketed in Pennsylvania.”
